Preface

As a user of this website, you accept that any use of this website by you including any transactions you make is subject to the terms and conditions noted below. Please read through these terms and conditions fully before using this website as your use of the website will imply your agreement to be bound by them. Please also read our Privacy Policy regarding your personal information.

We reserve the right to vary these terms and conditions at any time. Any such variations will take effect from when they are posted on the website and it is your responsibility to read the terms and conditions on each occasion that you use this website. Your continued use of the website shall imply your acceptance to be bound by the latest terms and conditions.

These terms and conditions do not affect your statutory rights.

1. Order & Purchase Process

1.1 All orders placed on this website or through (Gems4less Ltd t/a) Quality Diamonds (hereafter referred to as QD) will be subject to acceptance with these terms and conditions
1.2 The 'Order Now' stage sets out the final details of your order. Following this, we will send you an 'Acknowledgement of Purchase' email detailing the transaction and goods you have purchased.
1.3 If you do not know your ring size please select “Not Known”, and we will make the ring a standard size ring (between L-M). Once you have received the ring and are able to determine the correct ring size, you can return the ring back to us for one free re-size within the first 30 days. Rings returned after the first 30 days for a resize will incur a charge unless an exception has been agreed by prior arrangements.
1.4 By clicking the 'Confirm Order' button to submit your order on the checkout screen you are agreeing to purchase goods at the price stated at the time of ordering.
1.5 A binding contract is formed only when you receive confirmation from us that your order has been accepted.

2. Supply

2.1 Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. In the event of a specific diamond not being available, where possible, we will offer you a free replacement or free upgrade at no extra cost.
2.2 In the event that you have paid for goods that are not available and do not want to take up the offer of a free replacement/upgrade we will provide you with a full refund.
2.3 We reserve the right to refuse to supply any goods ordered.

3. Order Acceptance

3.1 In considering your payment we will verify your ID via Tyl by NatWest and PayPal using their Address Verification Service and Card Verification Code provision. These services sit alongside each merchant's Fraud Prevention Service and provide a mechanism for checking the authenticity of a transaction by comparing information entered by the shopper during the payment process, with details held by the card issuer. It is therefore important that you give us accurate and up-to-date information when processing your order.
3.2 On occasion we may ask you to provide two forms of additional ID in the form of a valid UK Driving Licence or a valid Passport AND a current utility bill.

4. Payment

4.1 We accept online payment by all major credit and debit cards, including Visa, Mastercard, PayPal and American Express.
4.2 For all UK Orders we accept all major credit and debit cards, BACS transfers, and CHAPS transfers. Cash payments are limited to £10,000.
4.3 For all International orders we accept credit and debit card payments, or Bank Wire/Transfer in US Dollars (USD) or Pound Sterling (GBP). Due to the high level of fraudulent transactions, we cannot accept credit card payments from the following countries: Bulgaria, Cameroon, Egypt, Gambia, Ghana, Indonesia, Iran, Israel, Lithuania, Malaysia, Morocco, Nigeria, Pakistan, Romania, Russia, Turkey, Ukraine and Vietnam. 
4.4 If payment is made by BACS the prices indicated on the order are guaranteed for 1 week whilst the payment is being processed. After this time the order value may be subject to revision. The order will not be processed until funds have cleared and will be subject to availability.
4.5 Title to any goods purchased on this website shall pass to you on delivery of the goods provided that we have processed and received cleared funds in full for the goods.
4.6 All prices are in pounds sterling and include UK VAT where applicable. Overseas customers will not be charged UK VAT, however, they are responsible for any customs fees or import duties.
4.7 All prices include delivery charges unless expressly stated.​
4.8 QD may at its sole discretion refuse or cancel your order, in which case QD shall return any monies received from you, within 14 days of receipt of such monies via your original payment method.
4.9 You will only own the goods once we have received cleared funds in full. Until such time goods remain the property of QD. In the unlikely event that you receive goods you have not paid for and you are requested by QD to return the same, you have to do so immediately without delay. Failure to do so may result in charges of interest being made to you in the amount of 2% above the NatWest rate and calculated from the day you receive the goods.
4.10 Finance is available through V12 Retail Finance Ltd and is subject to approval. To apply you must complete an online application form for 6, 12, 24 or 36-month terms. Details of Finance available can be found here.

5. Delivery

5.1 All deliveries are subject to payment authorisation.
5.2 We currently deliver products FREE OF CHARGE to the Mainland UK via Royal Mail Special Delivery service and anywhere globally outside the UK via FedEx. All shipments are fully insured.
5.3 In special circumstances, the delivery agent may be a different agent, nominated by QD
5.4 Please contact us if you'd like us to ship your order to an address other than the registered cardholder's address. Additional ID will be required.
5.5 We aim to deliver within 10-14 working days from receipt of the order. Delivery times for goods made to order may be longer and will depend largely on the extent of customisation. If you have specific date requirements, please inform us. We make every effort to deliver goods within these specified timescales, however, delays are occasionally inevitable due to unforeseen factors. QD cannot be held liable for any loss you may suffer as a result of late delivery.
5.6 Risk of loss and damage of goods passes to you on the date when the goods are delivered.
5.7 Goods are deemed to be delivered when delivered at your delivery address as provided by you when placing the order or collected at the collection address as indicated by our delivering agent and not when delivered to you personally.
5.8 Please check the goods on delivery. If goods are delivered damaged or faulty you must inform us within 10 days of the delivery date. If you do not inform us within 10 days QD will have no liability for goods said to be damaged on delivery.
5.9 Upon acceptance of delivery, insurance and protection of goods becomes the sole responsibility of the recipient and QD shall not be held liable for any loss, theft or resulting damages that may subsequently occur.

6. Guarantees, Returns & Refunds

6.1 FREE lifetime Manufacture Warranty.

6.1.1 The QD lifetime warranty covers any manufacturing defects. The item must be inspected and identified by QD as being defective as a result of a manufacturing default, after which a FREE OF CHARGE repair will be undertaken.
6.1.2 Maintenance, repair, sizing or other service performed by anyone other than QD will void your Manufacturer Warranty.
6.1.3 We do not provide warranties for damage due to normal wear, product loss, loss of stones or theft. Damage of loss that results from failure to obtain repairs necessary to maintain the integrity of the product is also not covered.

6.2 Price Match Guarantee

We strive to bring you the best prices humanly possible and we truly believe you won’t find better value in the UK on 100% natural, certified, untreated diamonds. Every Diamond is unique; however, you will find many Diamonds that have the same graded qualities but may be advertised at different prices. If you do find a cheaper Diamond of the same graded qualities, from a reputable high street or online retailer that we can verify is in stock, available to purchase and not at a one-off sale price, then please let us know; in this instance, we will happily order you the Diamond you have found elsewhere, match the price promoted on the retailer's website, then beat it by 2%, up to £75.
6.2.1 If we are unable to source the Diamond you have found, we will look to provide you with a Diamond of the same qualities and size.
6.2.2 Price Match cannot be used in conjunction with any other discounts or promotions.
6.2.3 Price matches are subject to verification and approval by QD. Price matches are only applicable to identically graded certificated diamonds. Diamonds will be compared according to the Four Cs; Cut, Colour, Clarity and Carat weight AND additional factors including, but not limited to; fluorescence, polish, symmetry, table and depth percentage.
6.2.4 For a price match to be accepted, the item must still be shown as available on the competitor's website; we will then source this Diamond for you.
6.2.5 Price Match excludes items sold through auctions, private sellers or second-hand items.
6.2.6 Price Match will not apply if the relevant Selected Retailer is in administration or closing down.

6.3 No Questions Asked; 60 Day Money Back Guarantee

Under our “No Questions asked, 60 Day Money Back Guarantee”, if for any reason you are not entirely happy with your purchase, we will provide a full refund or exchange provided that the goods are returned to us in the original unworn condition. The item must be returned to QD together with the original packaging and diamond certificate within the first 60 days. *This does not include Bespoke items. Please see section 6.3.14 - 19
6.3.1 For goods that include diamonds priced over £10,000 excluding VAT QD reserves the right to restrict the limit of the return period to 7 days.
6.3.2 All returns are subject to verification and authentication by QD
6.3.3 QD offer 1 FREE re-size on all solitaire and diamond set solitaire rings as long as the re-size takes place within the return policy range. In the case of wedding and eternity rings, re-size availability will depend upon the style chosen and may be limited to 3 sizes either way of the original ring size. Further re-sizes will be subject to a charge of £35.00 including VAT.
6.3.4 Should the customer require an exchange on the ring mount, QD will readily reset the diamond in a design of their choice free of charge. Where the replacement mount selected is a higher value than the original price, the customer will be required to pay the difference. Conversely, if the new mount is less than the original mount price we will provide a refund on the difference.
6.3.5 Goods should be returned to us by Royal Mail Special Delivery, within 60 days of you having received them.
6.3.6 For any return you must include a cover letter stating your name, your return address, daytime telephone number and original order reference number.
6.3.7 For security reasons we recommend that you do not use our company name Quality Diamonds anywhere on the packaging of your returned item because it includes the term “diamonds”. Items should be returned to:

6.3.8 Non-return of the original copy of the diamond certificate will be charged £250 for a replacement certificate.
6.3.9 QD will not accept liability for the cost and insurance for returns or for any loss or damage of return shipments
6.3.10 QD reserves the right to extend the 60-day money-back guarantee at certain times of the year such as Christmas.
6.3.11 For your protection, we recommend that you make sure the goods are adequately packaged and insured for their return journey.
6.3.12 Once the returned goods have been verified and authenticated by QD, we aim to process your refund as soon as possible. Depending on the payment method, it may take up to 14 days for the credit to appear in your account.
6.3.13 For an exchange, a credit will be issued which you can then apply to the purchase of an alternative item from our range.
6.3.14 Bespoke designs are non-refundable, and we require you to sign an agreement confirming this when ordering any bespoke jewellery. This includes Engagement rings, Wedding rings, and other jewellery pieces.
6.3.15 A ‘Bespoke’ item, is one that has been designed by our in-house designer using our CAD software, and then cast and handcrafted uniquely for you. As these pieces are one-off designs, and materials that are used and processes that are carried out are done so specifically for you, we cannot re-use the jewellery piece for anything else.
6.3.16 Bespoke pieces are still eligible for a free ring size within the first 30 days.
6.3.17 When designing your bespoke piece, we require a £250 non-refundable deposit, for the creation of your unique CAD design. When you are happy and have confirmed your consent to proceed with the design, the remaining cost of the total balance is required.
6.3.18 All Bespoke orders require full payment of the Setting before the manufacturing process can begin.
6.3.19 Once you have collected and fully paid for your Bespoke piece, only the central Diamond used will be eligible for a refund within your 60 days.

6.4 Upgrade Policy Terms & Conditions

As part of our commitment to you, Quality Diamonds is pleased to offer a lifetime diamond upgrade programme on all GIA-certified diamonds.
6.4.1 Diamond
Only GIA-certified diamonds purchased from Quality Diamonds are eligible
You will receive a credit equal to 100% of the original diamond price towards the purchase of your new diamond.
The price of your new diamond must be at least twice the price of your original diamond
Your diamond must be in its original condition
Your diamond must be accompanied by its original diamond Grading Certificate
Any damage to the original diamond or Certificate may disqualify the diamond from our upgrade programme
All diamonds must be inspected by QD prior to finalising the upgrade agreement.
6.4.2 Setting
The credit will be based solely on the value of the diamond, if you wish to change your setting this will be at the current website cost.
If you do not wish to change your original setting; and it fits your new diamond and is in a reusable condition we are happy to set your new diamond in your original setting.
Any diamond not originally set by Quality Diamonds must be returned without the setting.
6.4.3 Diamond Grading Reports:
The original diamond grading report must be returned in a reusable condition.

6.5 15% Wedding ring offer

Quality Diamonds 15 per cent Promotional Discount (the "Promotional Discount") is offered by Quality Diamonds: Gems4Less Ltd to encourage customers to purchase their engagement ring and both wedding rings and receive a discount on the lowest value wedding ring.
The purchase of a diamond ring is necessary to qualify for the discount. After which a 15% discount will be applied to one wedding ring, if both wedding rings are purchased from us.
6.5.1 Eligibility to Enter. The Promotional Discount is open to Individuals:
Who are residents of the United Kingdom;
Who are 18 years and above;
Have agreed to these Terms and Conditions;
6.5.2 The Promotional Discount offer for Engagement Rings is valid on internet orders, over the phone or in person at one of our showrooms. Wedding ring orders applicable for Promotional Discount offer would be accepted via this website, over the phone or in person at one of our showrooms.
6.5.3 Customers are required to quote their original job order number and quote IWB15 at the time of placing their wedding ring order.
6.5.4 Standard QD resizing policy will apply to all wedding ring orders.
6.5.2 Exclusions
This offer is not applicable to employees of Quality Diamonds, Gems4less or their affiliate or subsidiary companies, the immediate family members and household members of such employees, or a person involved in the development, promotion, marketing, advertising, administration for this Promotional Discount offer(each of whom is not eligible to enter or win). For purposes of this Promotional Discount, "immediate family members" means parent, child, sibling, grandparent, or grandchild. Each eligible person or entity that avails the Promotional Discount will be referred to in these Terms as a "Customer."

6.6 Recommend a friend

If you have a friend (or a few) that has never ordered from Quality Diamonds, refer them to us and you could both save up to £100 on your next order! We will keep their details on file and when they place an order with us we will contact you to explain how to claim your discount.

6.6.1 You cannot refer yourself.
6.6.2 Your friend must be a new Quality Diamonds customer, and you must provide their Full Name and email address.
6.6.3 There is no limit to the number of friends that you can refer.
6.6.4 This is available to all friends referred after January 1st 2019.
6.6.5 Your discount will be applied to future orders and cannot be applied retrospectively.
6.6.6 This discount cannot be used in conjunction with any other Quality Diamonds offer.

7. Intellectual Property

7.1 You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and content made available as part of your use of this website shall remain at all times vested in us. You are only permitted to use this material if expressly authorised by us or our licensors (as appropriate). The content of this website (including without limitation any video, pictures, text, audio, audio-visual materials and graphics) may not be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, except for the purpose stated below.
7.2 You acknowledge and agree that the material and content contained within this website are made available to you for your own personal and non-commercial use and that you may only download such material and content for the purpose of using this website. You further acknowledge that any other use of the material and content of this website is strictly prohibited and you agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

8. Liability and Indemnity

8.1 Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability which may not otherwise be limited or excluded under applicable law
8.2 We will not be liable for compensation or damages if we do not supply the order or a part of the order.
8.3 You have the right to cancel the order if we are unable to deliver within 30 days. We will not be liable for any compensation or damages as a result of late or non-delivery.
8.4 We do not accept any responsibility for any website not under our control which may be linked to this site.
8.5 In respect of compensation or damages we limit our liability to the total sale amount received for your order.

9.1 Subject to Clause 10.1 below, QD will use reasonable efforts to verify the correctness of any information on our website but make no representation or warranty of any kind whether express or implied statutory or otherwise regarding the content contained herein or availability of the site or that it will be timely or error-free, that defects will be corrected, or that the site and server from which it is made available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website QD will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and QD accepts no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the website.
9.2 Images displayed are not actual size. All sizes, measurements and weights are approximate and included for guidance only. We endeavour to make every effort that the information provided is accurate.

10.1 QD reserves the right to vary these terms and conditions at any time. 10.4 Each Term and Condition set out in this document shall be construed separately and will remain in force even if for any reason one or other of the Terms or Conditions is held inapplicable or unenforceable.
10.5 Section headings have been included in these Terms and Conditions for convenience only and are not to be used in their interpretation.
10.6 Your statutory rights are not affected by these terms and conditions.
